I am being sued by a clooections shister. Can he collect, the landlord already wrote it off. I left under a stipulation in their own lease, and the did not have the truth in renting act notice in the lease, and also they failed to mitigate damages

It appears that your landlord assigned his interest in any money you owe over to the collections agent. If you have a defense against the damages, then that should be raised, however, one would expect that to have been resolved previously. If the landlord obtained a judgment against you, then you likely have no further chance to raise any issue. The collection agency is required to follow the letter of the law in attempting to collect from you.
