Legal Question in Landlord & Tenant Law in Michigan

Lease Term and Breaking Lease (Apartment)

9/08 we signed our third 12 mo. lease in a Non-Dog bldg. 1/09 the bldg was changed by landlord to a dog bldg with no notice given at the time nor at our lease renewal back on 9/08. We now have dogs in the bldg creating a noise nuisance for my wife and I working both 1st and 3rd shifts. The only option given to us was to relocate to another bdlg at our expense. Our lease has the option to break and would cost approx. $2100 to walk away. Do we have any other recourse in the matter?

Re: Lease Term and Breaking Lease (Apartment)

I'm sure I could negotiate an out to your lease for less than they are quoting you. There is a right to quiet enjoyment they are breaching. You should first put them on written notice of your complaints, then contact me at www.kliszlaw.com to hire me for representation. Tim Klisz
