Legal Question in Medical Malpractice in Michigan

Dental Nightmare

I've been going to a cosmetic Dentist since Feb. It's been well over 3 months, and my proceedure still isn't done... I visit there twice a week, I was promised perfect teeth... Now I have invested 3 months, trying to get a couple of teeth (front) just close to perfect... Now the Dentist as ruined my gum line, it's much too high (and ultra sensitive) and looks silly when I smile... and the tooth still isn't ready (wearing a temp... since FEB) ... I was promised a perfect smile, in a couple of weeks... I'm stressed out because my teeth look stupid and fake. I asked him about this on day one... he said they will look beautiful and I will love them. Now all I see when I smile is my own stupidty for being so vain that I wanted a couple of gaps filled in. It's cost me $2,200, I've been unable to go on vacation, canceled numerous dinner dates, plans... spend a ton in gas just driving up there at least twice a week... his incompetance is overwheling to me and my psyche is just spent... now I have to wait another week... because they are all on VACATION! Must be nice not to be tied to the dentist and be able to enjoy life! I'm just discusted... and have finally broke down and cried. What can I do?

Re: Dental Nightmare

In order to obtain damages, you would need to prove that your dentist made a mistake or committed malpractice, versus just not making you happy. You could start with a demand letter from a lawyer, outlining your situation and demanding a refund or partial refund. The strength of your "case" also depends on what he promised you, and what was placed in writing. There are a million definitions of a "perfect smile," and while you two disagree, it doesn't necessarily mean he did something wrong-but again, I haven't seen your before and after pictures, so it's difficult for me to fully opine (plus I'm not a cosmetic dentist).

Pursuing a malpractice case would be an uphill battle as you have to retain an expert, pay a few thousand dollars to get an opinion on whether your case has merit or not, and then pursue litigation. In this case, since you aren't seriously hurt, a lawsuit is likely not worth it.

However, a letter from a lawyer may prove worthwhile, depending on the doctor and his attitude/position.

I am sorry for your discomfort - I know how it is - especially with your smile - most people are extra paranoid about their smile and worry about it, even when it might look perfect to others.

Have you visited another dentist and asked for their opinion?

If you would like to retain me to write a letter to the doctor and discuss a refund or payment for corrective treatment, please contact me to schedule an appointment.

Hang in there. It will get better.

Thanks.
