Legal Question in Personal Injury in Michigan

Go-cart injury to a child

14 yr. old girl ran into a wall at the go-cart park. Injuries resulting were: Whiplash, puncture wounds to hip and lip, swollen knee. Injuries were documented at local emergency room and treatment was paid for by park. The go-cart did not have proper restraint system and park did not have accident reports to fill out.

Do we have legal recourse in this matter? In other words, is it worth pursuing a suit against the park (which is owned by a hotel chain).

My guess is that they had the adult with the child sign a release. Most do nowadays. These releases are difficult to get around. These cases are also expensive in that you need good experts and they charge a lot. If the injuries are not severe, the costs and aggravation of pursuing the case may make it prohibitive. Bill Stern
