Yes, you can be sued, or even prosecuted criminally. Since you were around a person who stole a car after drinking, the attorney representing the estate of the dead person, and/or the Prosecuting Attorney will attempt to determine if you knew or could foresee that this guy was going to drive drunk and possibly kill someone. You will have to prove that you were not part of the crime, that you didn't know the crimes were being committed, that you had no contact with the person who committed the crime, and that you could not foresee the outcome of this situation.
