Legal Question in Real Estate Law in Michigan

breech of contract

we live in florida and wish to move back to michigan. we have put an offer on a home and it was agreed upon us selling our home. our offer stands until January 15th 2006. If the seller takes the home off the market can we go breech of contract ? if yes...what do we benefit and how do we go about this ?

If the offer to purchase the Michigan home is contingent upon the sale of your Florida home by a certain date, then if you sell your Florida home by that date you are obligated to close on the Michigan property. And if your Florida home does not sell timely, then you are free to terminate the Michigan contract and have your deposit returned. Of course, without actually reading your contract, I cannot provide you any other meaningful guidance. There may be other issues relating to deposits, financing contingency, inspections and other due diligence that may be very important from a seller and/or buyer perspective. You should consult a real estate attorney in person. Good luck.
