Legal Question in Real Estate Law in Michigan

Homeowner's Association

I recently bought a house. It was a foreclosure and I bought it from the bank. I was never told there was a homeowner's association. I closed 7-24-08 and found out about the association on 10-20-08. I never signed anything in regaard to the association. Am I obligated to be a part of it?

Re: Homeowner's Association

It depends on the rules of the HOA, but likely yes, you have to be a part of it simply by owning the house within the jurisdiction of the HOA, which requires you to pay dues in almost 99% of cases. You may have a cause of action against your real estate agent for failing to disclose this fact, if you will experience damages as a result of it.
