Legal Question in Traffic Law in Michigan

Michigan No-fault Insurance Laws...

In a recent incident, my wife and I were run off the road by an oncoming vehicle. The person fled the scene and when contacted by police,admitted to falling asleep at the wheel and was henceforth issued a citation. Damage to vehicle suspension did occur. My insurance is picking up my tab and then suing this persons insurance company. Can I still sue that person for the $500 that Michigan Law limits and/or more? The inconvience of this whole incident has been a nightmare not to mention almost being killed!

Hello, I have just received the message that you posted regarding your car accident. In most cases you are limited by the no-fault law in your ability to bring suit if you haven't sustained a "serious impairment of body function." There are some exceeptions that exist if there are replacement losses or wage losses in excess of what has been covered by your insurance company.
