Legal Question in Wills and Trusts in Michigan

Can an Inheritance be ''liened'' for past debts?

I have an x-husband more than $25,000.00 in debt for child support.

Michigan's Friend of the Court hasn't pursued him.

However, he's within a few weeks of recieving an Inheritance due to a family members death.

Can I somehow legally file a claim against this inheritance?

Thanks,

Patti

Sure. A claim must be filed with the probate court. The court should honor the claim and you'll get your money. If you wish to discuss this further, give me a call at 248-353-9400.

You need to convert your claim to a judgment as soon as possible, then go after the inheritance as soon as he gets it. The other alternative is to contact the state agency that pursues deadbeat dads.
