Names on house title

My uncle died in 1968 and his name still appears on the title to my aunt's home. She is 94 and has a will. Should we get his name taken off the title before she passes away?

Yes, you can remove his name from the title by executing an heirship affidavit. You should check the law as it existed in 1968, as heirship was different then.

Your situation brings up a bunch of questions - did he die with or without a will? did he have children - were any from a previous marriage? You need to make sure you have the title clear in the event you want to sell it.
