Legal Question in Workers Comp in Michigan

workman's comp or ????

I was recently awarded an open award for a workmans comp case. My employer had no insurance, so my attorney gave my case to another attorney at the same firm who took the case and filed a civil suit against my employer. Does this attorney have to follow workers compenstaion laws as far as his compensation or can he charge me what ever he wants....he says 1/3 of the settlement.
