Legal Question in Bankruptcy in Minnesota

Attorney Fees - When does the ball start rolling

Obviously, attorney's fees for a chapter 7 Bankruptcy case are expensive. If I make a down payment of 75%, does that get the ball rolling? I know the case wont be filed until all fees are paid, but can I legally inform creditors that I have retained an attorney prior to paying him/her in full?

If the attorney accepts a partial fee, he or she has been retained and you can tell the creditors that. I often do that. Dennis

Re: Attorney Fees - When does the ball start rolling

My usual fee for a consumer Chapter 7 case these days is $2,000 plus the filing fee of $299. However, it takes me a month or so to put it together so it's ready to file. So I say I'll consider myself hired if the client can give me $1,000 up front. Then I collect the rest before we file.

Often I'll ask for a $100 consult fee, which I credit toward my fee later. So after paying the consult fee, lots of folks come back later with $900 to hire me.

I see your zip code is practically walking distance to my office. I'm on the St. Louis Park border with Minnetonka.
