Legal Question in Bankruptcy in Minnesota

I am a co-signer

I am a co-signer on my sons loan and I filed bankruptcy. Is he still obligated to pay this loan? The account has been closed because of the bankruptcy.

Ah. There's an interesting turn of events.

Yes he is still obligated. BUT, it may be that the lender saw your bankruptcy notice and closed the account without noticing that they still had somebody obligated to pay.

Your son may find that they will never come after him for the money. On the other hand, they may delay a while and come after him later. Your son's choice is to gamble that they won't notice him and they'll leave him alone; or make arrangements to pay on the theory that they will be after him sooner or later.

This is an item that will probably show negatively on your son's credit report too as long as it is not paid.

It would be an interesting exercise to pull a credit report on your son and see if this item is there.
