Identity Theft/Unauthorized Computer Access

How likely is a County Attorney to draw up charges in this case? ex wife changed a password to enter her ex husbands hotmail email account and deleted emails she had wrote to him. He is pressing charges for one of the crimes listed in the subject line. She created the account while married and therefore knew the security question to change the password. will a county attorney seize computers as evidence in something like this?

It is not particularly likely that charges would be filed between spouses. THere is an inferred permission to use accounts and it would be difficult to demonstrate that such access was not allowed. Moreover, there is an adequate civil remedy in divorce or legal separation.
