The airbags did not deploy and we lost our unborn child.

I have a 99 galant with a SRS system in it. My fiance was traveling well within 35-45 mph going thru a tunnel on hwy 94 west. The steering collum locked up and the car began swerving. The car then went into a tail spin slamming the front end of the car into the wall located on the driver side of the car. Then spinning around and hitting the back end of the car. After all this took place the car ended up in the far right lane/or passenger side of the car. When the state trooper explained the accident to me. He stated that he notice the airbags had not deployed. This car has front and side airbags. Is it possible I may have a case. Not only did we lose a car we where still making payments on but my fiance was 5 weeks and 2 days pregnant at the time. She miscarried because of the collision. Pain and suffering and mental anguish can't replace a child we where expecting. The dealership says that we are liable for the car. I suspected that the car may have been in a accident previously. So I checked carfax. Come to find out it had 7 different history reports on the car. Am I liable for this car, and can I sue. Just looking for some legal advice here.

First of all, condolences for your terrible loss, which must be very difficult.

It certainly appears that you may have a claim for the non-operation of the airbag, whether based in tort or contract law.
