Legal Question in Credit and Debt Law in Minnesota

Who's fight is this? MyCheckFree, JCPenney, or me?

I have authorized MyCheckFree.com to receive my billing statements from JCP, they then send me emails to notify me that a payment is due, which I pay online. JCP encourages paying bills online with MyCheckFree. I purchased one item in February that I never received an e-bill for and that I never received a paper bill for. JCP's collection agency is demanding payment. MyCheckFree tells me they did not receive a statement from JCP for that item. After I wrote a dispute letter to JCP's recovery agency, they sent copies of all statements they supposedly sent me, with no letter attached, no name, no phone number to contact. I never received a single paper bill. What should I do? Pay the bill and let my credit rating suffer? Try to get MyCheckFree to do something? JCP has not been cooperative. I'm really upset about this because my credit has been excellent and this one item could ruin my history. Your advice would be greatly apreciated.

You need to contact BOTH JC Penney and MyCheckFree by certified mail, return receipt requested and do a cc: MN Attorney General. Give them 2 weeks to respond, and if they do not, contact an attorney.
