Legal Question in DUI Law in Minnesota

Felony DWI conviction

Went to court with a public defender in March 2008. Pleaded guilty. 42 month stay of execution. 6 months or staggered sentencing. Received latter. Just recently received court date (5/15) for probation violations. What are my chances of staying out of jail? Do they take me right away? Length? How can I provide documentation to hearing judge prior.

You may admit or deny the probation violations. If you deny them, you should be prepared to have a heariong on the violations where testimony can be taken. If you are found to have violated probation, the Judge has many options including executing any time previously stayed. It is impossinble to determine what a Judge may or may not do without much more facts.

Obviously, there is a great deal at stake when you have 42 months hanging over your head. You should hire an experienced attonrney.

If a probation officer claims a person violated a condition of probation, they can request an arrest and detain order form a judge, or a summons. Normally there are two court appearances, a first "admit or deny" date, and second a hearing date. The issues are generally did the person violate a condition; and if so, what is the appopriate remedy for the court?
