Custody

My ex has physical custody and I have joint legal, but she is now in jail. She will be going to treatment afterwards. My son is living with his grandparents which is where she lived. Can I go and get him and keep him until she gets out?

Re: Custody

You must file a Motion to change custody in the court that issued the original order. As part of that process, you may seek ex parte relief awarding you immediate custody pending a hearing. In the alternative, you would nbeed a stipulation and order from the other parent regarding the custody change.
