Legal Question in Family Law in Minnesota

My husband and I live in Minnesota. We are seperating and I want to move back to Indiana. He states I can not take our children. Can I legally take the children to live in Indiana without his consent?

Until there is an order to the contrary, neither parent is restricted from travel. However, if you seek to relocate permanently to another state, your spouse may very well file a divorce or legal separation action and, as part of that action seek and acquire the immediate return of the children to their home state.
