Language clarification

The court order states; Mother shall be allowed to claim the minor child as deduction for state and federal income tax purposes in 2002 and all future even years thereafter. Father shall be allowed to claim the minor child in 2003 and all future odd years if he is current in his child support obligation for the tax year that he is claiming.

The father is current in child support obligations. Who is allowed to claim the child for taxes right now in 2009

Re: Language clarification

If he is current on December 31, 2009, or any other odd numbered year, th e language indicates that he may claim the child for that year. The moother would claim the childd for the 2008 tax year based on the language even though those taxes are filed in 2009.
