Legal Question in Landlord & Tenant Law in Minnesota

I received a notice of a rent increase stating: �the new rent will be 9.00PSF, that is in addition to utilities. This is a letter of intent to make this effective 1/1/2015. We will need new leases on all the units��those of you who have existing leases please consider this your notification of rent increase.�

my existing lease �term� is: �One (1) year commencing January 1,2014 and terminating on December 31st, 2014. After December 31, 2014, this lease will revert to a month to month lease with a 60 day written notice to vacate or change terms.�

My question is, does my existing lease revert to a month to month/60 day notice and push back the rent increase 60 day into the new year or is the landlord following the proper procedure?

I would argue that unless you received the above written notice prior to Nov 1, 2014, the notice is INEFFECTIVE to raise your rent for the coming months.

A new Notice with proper 60 day notice would be required

( e.g. Notice given NOW [Dec 23] could not raise your rent until Mar. 1, 2015. Notice given Jan 2 could not raise your rent until April 1, 2015)
