My boyfriend was picked up for a DWI and was put in jail. He has a heart condition and a pacemaker, he is on several different medications to keep them regulated. He needs to take these on a daily basis, he had them delivered to the jail on Saturday morning and had ask the jailer if his medication was there and if so if he could have it. The jailer refused his request to give him his meds, later that day he was transported to the hospital where he spent the night.

Is this considered negligence on the County? Can he sue for that?

Probably. It depends on his injuries, pain and suffering and damages.

The County jail may be liable under 42 U.S.C. Section 1983 for denial of medical treatment (a civil rights violation).
