Legal Question in Wills and Trusts in Minnesota

death w/o a will

A property owner in a town home assoc. recently died intestate. She was single/divorced a long time ago and has two adult sons of highly questionable behavior. The assoc. is very concerned that one or both sons may move into the home therein causing great concern and possible financial stress to it's members. Is there a way to bring these concerns to the attn. of the Probate Court so they can address the issues?

I am afraid that the is no way to preclude the sons from taking ownership based on the intestacy statute if tyhere is no contract that provides a limitationm on alienation of the real estate.
