Legal Question in Wills and Trusts in Minnesota

forced sale of real estate owned in equal shares

My 3 sibs and I own my deceased parents farmstead, in equal shares. My brother is the PR and appears to be in no hurry to sell. Dad died in 2001. He also won't allow me to rent or contract it. I have been near homeless a couple of times due to employment issues and health issues. Can they be forced to sell the real estate or buy out my share? What would the process be to get this started if it is possible? I am in a desperate situation.

Re: forced sale of real estate owned in equal shares

Is your brother living on the place? There is an issue as to what the Will might have said. However, assuming for restrictions, you have the right to have the property split up or sold but you will likely have to bring action to do so. Dennis.
