Legal Question in Criminal Law in Mississippi

I have question, someone who lives out of state decided to purchase a cell phone in their name for my sister. My sister never asked him to not purchase the phone but he got it for her anyway. Things between the two aren't going so well so the guy says that they should separate but she can keep the phone and it will remain active until he finds someone else. Today the guy tries to get back with her and my sister said she's not going back he tells he wants it back and was going to press charges against her if she didn't give him the phone back. My question is does he have the legal ground to press charges against her?

She needs to return a phone in his or her name. It is legally his or her phone. Give the phone back. She can argue it was a gift, but if she is arrested she will have to defend herself. No phone is worth the hassle
