child custody in non marital relationships

i am a single divorced mother of two children, a 5yr. and 1yr. the 1yr. old's father and i were unmarried he left in nov. 2003 and seen child only three times i want to know who has custody if anyone and what i need to do to ensure i have it. just mobilized to active duty with military w/in US. will have time for care of child. father states he will get child and have custody:::

Now that you have been mobilized, you have access to free legal assistance through the military judge advocate's office. You should consult with an attorney there to fully develop your fact situation and plan your actions. The court will act in what it considers to be the child's best interest. Some of the considerations for the court are who has had the continuity of care for the child, the benefit of continuing a relationship between your children by keeping them together, and who has the capacity to nurture. Your duty requirements will be a consideration as well as the father's. It would strenthen your situation if you had a family member with you who could take care of the children while you performed your daily duties.
