Child custody and child support

in 1993 my ex-wife was granted custody and I paid child support, in 1998 I was granted temporary custody and neither party paid child support in aug. 1998 a court order was issued of joint legal custody with me having paramount control custody and my ex-wife was not ordered to pay child support because she didn't have a job, in aug. 2002 my daughter decided she wanted to go live with her mother and with her being age 15 I figued the courts would go alone with it so I let her go and her mom said we would leave the papers like they are and she didn't want child support, but now DHS is requesting child support from me, because my ex-wife has filed for Gov. assistance, by the way I provide Full medical, dental and vision Ins. and supplemental Ins. on her. Is this legal by DHS and do I owe Child support when my ex-wife didn't pay and my court papers still say I have coustody and my ex does'nt pay child support.

If you are going to allow your daughter to remain with her mother, you are going to end up paying support. You do have the option of making your daughter move back in with you since you do have custody.
