Re: child custody and visitation

The mother must look first to the visitation agreement. She has all rights that are not expressly given exclusively to the father. Additionally, the agreement has the implied obligations of reasonableness and good faith. However, she cannot unilaterally modify visitation rights or otherwise affect the father's visitation rights for his failures to pay child support. If an emergency situation arises which threatens the safety of the child, she can act on that basis but she will have to have evidence showing good cause why she should not be held in contempt of court for violation of its visitation order.
