Legal Question in Immigration Law in Mississippi

there is a guy that is in custody as we speak in Mississippi ...he was stopped on a routine traffic stop but beer was found in the car ...he was drinking but not driving but he is only 20 years old so they asked to see ID and he didn't have any so obviously he is illegal.

Now he and his mother have been in the system awaiting a visa since he was young and apparently the mother has a a paper saying she can stay in the country...is there any way that his deportation can be prevented, and if so what are the steps to doing so?
