Legal Question in Consumer Law in Missouri

Bad Buy

My husband bought a truck, they leased it to him with out full coverage insurance. He was in a wreck and the truck is no longer driveable. It was setting on my husbands ex-step father and his mom's property. His ex-step dad left the truck on the back property and then sold the motor and transmition to the neighbor, with out telling my husband. He also told my husband the truck was stollen.To long story short they made a deal and my husband sold it to his ex-step dad. Right now my husband and I are both unemployed and we can't pay the money we owe to the original title holder. What can we do to make sure he(the original title holder)doesn't take us to the cleaners?

Your husband may have some serious issues with respect to fraud on the title holder and lien holder. You are going to have to pay off the original lien holder in full as the lien holder has every right to enforce its lien and it can follow the property no matter who is in possession of it. The lien holder can go take it back from your husband's ex step father.

I would urge you to consult an attorney to help you with this issue soon so as to avoid potential civil and criminal charges later on.
