Legal Question in Criminal Law in Missouri

The house next door to us is a rental house. Recently a new "family" moved in there. It is a rather "rough" looking bunch with teenage kids who from day one have been very disrespectful and obnoxious around the neighborhood. They have been seen passing a rolled cigarette on the sidewalk in front of our house. I always park my car in the front yard horizontally with the sidewalk. One evening my husband went to put the dog out and discovered the two neighbor teens and three other teens around my car looking in the windows etc. He approached and ask what they were doing and plainly told them to stay away...an argument ensued and I heard him yell, "call the police." he said when he did that they began to scatter. He grabbed one of them by the arm in an attempt to detain him but the kid got away. I didn't see anything because I was inside calling dispatch. When the police arrived we told them the story and while talking with us the group of boys came strolling down the street. The officers stopped them and talked with them. They then came back and said that the boy accused my husband of punching him. They also said that the boy had a punch mark under his eye. My husband denied this and held his hands up and said, "does it look like I have punched anyone. The Mother of the kid is pressing charges. As it turns out the officers issued my husband a summons to court for 3rd degree assault. We have lived here 17 years. My husband has never been in trouble of any kind. He swears he didn't punch the kid....what is your advise?

Your husband needs to get an attorney soon. Grabbing and holding the kid could suffice to convict him of the crime now charged against him.
