Legal Question in Landlord & Tenant Law in Missouri

My son and I (as the guarantor) signed a lease for a room in a house for the school year, September 2014 to May 2015. My son moved out on May 27, 2015, and the landlord agreed to allow my son to keep his belongings in the house (at $100 per month for June and July) until August 1st, when he would return to school. The landlord sent a new lease in June, which my son opted to not sign the new lease and not return to the house; and removed his belongings on August 1, 2015. The landlord has now filed a Petition for Recovery of Rent and Possession of Leased Premises. Does the landlord have a case?

Without seeing the lease you signed and the agreement your son made to possess the premises after May, it is impossible to state his debt with certainty. But, based upon what you described, it sounds like he (and probably you) owe for June and July rent. You sound have a civil practice attorney (in your area) look at the two agreements. If there is just the one written agreement, you owe for June and July, because he failed to vacate in May.
