Legal Question in Medical Malpractice in Missouri

Hospital negligence

Okay spouse is in hospital for back injury and rehab. Ct scan is ordered. As procedure begins IV for dye apparently is anchored incorrectly and pulls out or vein. No one notices, machine is mechanically pumping dye, it doesn't quit pumping dye. Surrounding tissue is pumped full of dye, arm is swelling, spouse is screaming, and IV line explodes from the back pressure of trying to pump more dye into the already flooded arm. Machine is finally stopped. Arm swells to resemble something out of Popeye cartoon. Emergency surgery is preformed to remove and drain dye. arm is opened from wrist to elbow on both sides to drain.

Arm sits for 3 days open and packed to allow drainage. It will require another surgery to close incisions, and at least one to start skin graft process.

I know this is negligence on someones part, but I have also heard negligence is very hard to pursue. What do You think about this instance?

Re: Hospital negligence

Yes, this is called "extravasation", a known and serious complication if the treatment is not done correctly

Re: Hospital negligence

Med map cases are only difficult to win, but are also very expensive. It sounds like this is potentially a good case, but it will really come down to the amount of damage. Any long term damage to the arm? Feel free to shoot me an email or call.
