Can the veteran sue the VA for malpractice? If so under what time constraint?

You can sue the VA, but there are significant procedural hurdles you must first overcome, including filing a timely claim form under the Federal Tort Claims Act. If non VA physicians were negligent, they are not subject to the claim form requirement, but are still subject to Missouri's 2 year statute of limitations for medical negligence.
