Legal Question in Traffic Law in Missouri

DL Suspensions from another state

I had a DL in Missouri from 91 to 94 then moved to Kansas where I have had my DL since then. Last year my license was suspended in MO for a drug charge for one year and I skipped out on 6 months of probation.I stoped qoinq and paying.I went to renew my Kansas DL today which wasnt suspended and they said I was suspended in MO and have to straighten that out before I can get my KS DL Renewed. Is this legal for one state to suspend DL privledges in another state? How much jail time do you think I would get for blowing of probation? What should I do?

Yes, an offense in one state can get you suspended in another state. It happens all the time. As to how much time you'll get for blowing probation, it depends on a lot of things, especially your criminal record. One thing you can be sure of is that this is not going away by itself. You need an experienced criminal and traffic defense lawyer who is licensed in KS and MO to straighten this mess out for you. Feel free to call me at 913-648-7070 to discuss it further.

Re: DL Suspensions from another state

A couple of points, you had a Kansas license at the time you were suspended in Missouri for a year for a drug charge, but this does not mean your license was suspended, i.e.the State of Missouri couldnt take your Kansas license at the time, but only suspend your privilege to drive in Missouri.

You would have been able to validly drive outside of the state of Missouri on your Kansas license UNTIL YOU WENT TO RENEW. Missouri and Kansas are both members of what is called the interstate compact, and once Kansas saw you were suspended in Missouri, they will not renew you and consider you now also suspended in Kansas under the compact until you resolve the Missouri situation.

Your note does not deal with the criminal portion of your previous caseit only asks about the drivers license consequences. In addition to not being able to get your drive until the issue is resolved, you also most assuredly have a warrant outstanding for your arrest, along with a probation violation for failure to pay/failure to appear, and leaving the state.

You definitely need to hire a qualified attorney who has experience handling both the drivers license and the criminal portion of your matter. Re: DL Suspensions from another state

The replies already posted have been excellent except that you might not need a lawyer in Kansas. From my experience with similar situations, I can tell you that the first thing you need to do is hire an attorney to review the old criminal case and see whether 1) there is an outstanding warrant, and 2) whether the state has filed a petition to revoke your probation. Your attorney may be able to get the warrant cancelled or at least make arrangements for you to post the most reasonable bond possible and then handle the probation revocation matter. It might be as simple as your agreeing to take the conviction on the old case and pay a fine, or you might be looking at doing some time depending upon a variety of factors. If this old case was on the Eastern side of the state, I would be able to offer my services to you. If not, I would definitely advise you to hire a lawyer in the county where that case was pending. You may call me for a free telephone consultation if I might be of any assistance at 314-727-2822. Good luck!
