Legal Question in Wills and Trusts in Missouri

My son was killed in Missouri where

he lived. He has a 7year old son who is with the birth mother. His insurance is giving his trust fund $20000.00. As his mother I have not set up probate as I do not know if it is worth the trouble as I live in Michigan. His house is in his name only will be repo and is not worth what he owes. The new truck

he was shot in was sold by the bank but they have not told me what the loss was. He does owe about $3000.00 on credit cards. I did give him $40,000.00 towards the house and have a contract (not registered with court). Would I be able to get some of this money back for the house? What is the time limit after death to set up probate? Is money set aside from probate to raise his son? What is the repercusions if I do not file probate? He was shot in Oct 2006

First, I am sorry to hear about your loss, and the loss of a father to such a young son as well.

I wish I could answer these questions, but what you are asking is very state specific, probate and how money transfers, so I would encourage you to post this to the Missouri board and see about advise there. I can not provide any good assistance not knowing the laws of Missouri. Again, sorry for the loss.
