My question is in regards to my house. My mother passed away back in 2001. At the time she had not finished any paperwork granting me with everything. She did not have a will. I was told by the bank that held the morgage who allowed me to continue to pay off the house that it would go to probate. The house is now paid off and I am still not able to put the lease in my name. I was wondering what my next step should be in getting the deed to the house put in my name and my mom's name taken off. My fiance and I now are the owners of this house. What legal steps need to be taken at this time. I don't even know if it is still in probate or not.

It has been too may years since your mother's passing for a regular probate estate to be opened. What you need to do now is called a "Petition to dtermine heirship" It is the way that ttitle to teh house can be passed to you and any other similarly situated heris. You will want to do this through an attorney. It shouldn't cost very much.
