stolen medical records

i was sent a letter from a hospital saying that that photo copies of protected health information were found in possesion of a former employee can i sue

Not without a real legal basis for doing so. Consult a local lawyer,--mere possession of the material may not have been intentional or the fault of the hospital (if the records were stolen and the hospital followed best practices, for example).
