Legal Question in Construction Law in New Hampshire

Contractor law

I am a contractor in New Hampshire who hired an electrician to perform the electrical on a remodeling project. The electrician billed me via email on 2/27 when the work was completed. The invoice was dated 2/3. I don't usually pay final invoices for 60 days after the work is completed to make sure everything is okay with the work however, this is not in writing. The electrician has threatened to file a lien on the homeowner's property if he does not receive payment immediately. Can he do that?

Re: Contractor law

The short answer to your question is, "yes." The sub-contractor has a lien against the work completed. The fact that you determine to pay in 60 days should be in a written contract with the sub before any work starts. Otherwise, he's entitled to prompt payment.
