Legal Question in Criminal Law in New Hampshire

I was represented by Public Defenders office since April 09. my court date is 12-17-09. the Public Defender had me sign papers waving my right to a speedy trial, I did have time to read, as they said if I didn't sign they could'nt represent me. Then they sent me a letter a week later explaining there was a conflict of intrest on Nov 7 09 and the court assigned me a private atty by letter dated 11-10-09. I received it 11-14-09. I called this atty. and he said he had no paperwork and could'nt speak to me. I called his office once each week for 3 weeks and all I got was an answering machine, he never returned my call. I called the court they said the paperwork went out 11-10-09. I am now a week from trial and I want to know if I can ask for a dismissal on grounds of INEFFECTIVE ASSISTANCE OF COUNSEL

Ineffective assistance of counsel does not apply until AFTER trial. If your new counsel does not have sufficient information to conduct the trial, the court can grant him or her additional time to prepare.
