summons for shoplifting

i talked with a lawyer and he said that the store will try and make a deal with me..generally what kind of a deal is it?the amt is less than 100 dollars....i have a absolutely clean record.no voilations..no tickets..can they wave the charge ..give a warning...and does new hampshire has pre trial diversion programs.

If you spoke to a lawyer who talked to the store for you, you should probably address these questions directly with that lawyer. The store can have an influence on how you are charged but the final decision is up to the prosecutor, who does not have to follow the store's wishes. Yes, it is possible the charge could be conditionally dismissed or "placed on file without a finding." Yes, certain areas in New Hampshire offer pre-trial diversion programs.

Speak with your lawyer directly about this and if you don't have one, you will probably be able to get a court appointed lawyer at your arraignment. Until then, don't panic about this, go about your business, and keep your nose clean.
