Enforcing rules in condo

I live on an end unit in a condo and a guy who just moved in and starts to smoke on the steps of the building which is against condo rules. I can smell it each time he does it, and he wont move. The condo association has already sent a warning to him, but all it did was get me harassed and threatened with violence, and im afraid the condo association fining him will do nothing. My question is can I do anything legally to make him follow the rules( his arguemnt is he can smell when I smoke a cigar, but I follow the rules and smoke in my own apartment). Any answer would be appreciated. Thank You

The answer to your question would require a review of the condominium declaration and bylaws for enforcement provisions. Generally, your complaint is to the Board regarding their failure to take appropriate action. You could bring a private law suit, but that would be a costly step and not likely to produce the result you desire. Have you asked to meet with the Board to discuss the situation? I do suggest that you put all complaints in writing and keep copies.
