Legal Question in Wills and Trusts in New Hampshire

My mother died without a will in NH over a year ago. Intestate law would apply. She had remarried and had 3 seperate real estate properties. 2 lots were seasonal camps from her first marriage, our parents. The 3rd was her new marriage marital property (homestead) Which law takes place when dividing assets? Does Intestate law supercede homestead law? There is enough equity in the 2 seasonal properties to pay off debt without selling the marital homestead. Her late husband says he gets both 100,000 homestead provision and 100,000 Intestate provision...confused.. Thank you for any help you might be able to provide

More information than is contained in your post is required. What names are on the various deeds? I suggest that a careful review by an attorney would be a wise investment at this point.
