Legal Question in Wills and Trusts in New Hampshire

Resposible for mortgage on estate

My mother recently passed away she is the sole owner of the property in NH even though she was married she never had the deed or title changed to reflect him. He has taken her name off the mortgage and I am running the estate. How can he have a mortgage on property he doesn't own. Am I still responsible for this debt since he removed her name?

You are at an intersection of Probate law and Real Estate law. In order to properly respond to your question I would need to review the deed, mortgage and promissory note. The mortgage debt attaches to the house. I have to assume that both your mother and her husband signed the mortgage and promissory note. I am a bit confused as to who is entitled to the mortgage payments. Your descriptions is a little vague. I suggest that meeting with an attorney would probably be in your best interest.
