Legal Question in Elder Law in New Jersey

cost of guardianship of adult

My mother is in the late stages of dementia. My sister lives with her and is not taking proper care of her and wants my mother's house deed transferred to her. To protect my mother, I will have to contact an attorney to file for guardianship but have no idea of the cost. I've been told I can expect to pay over $2000.

If your sister fights your attempt at guardianship, your legal bills may be close int the range of $7,500.00 to $10,000.00.

$2,000.00 would be more in the range of what you would pay your attorney to file the action. If contested, it could be much higher. Any retainer you pay to an attorney may be reimbursed to you at the conclusion of the matter from the incapacitated person's estate if the Judge approves the fees and determines the action was brought in good faith.
