Can a Business structure be Patented?

I have recently come across new bussiness Idea. It is for an entertainment services company. Can this be patented? Or is it just the bussiness structure that can be patented? This is a franchise I hope to start but another company is already doing it on a structured fee basis.

Business ideas are not patentable but there are many aspects of business ideas that may be protectable in other ways. "Business processes" are currently accorded patent protection but not everything fits into the category of a business process. There are circles in which business process patents are in disfavor and there is a lot of pressure on Congress to limit them.

There is some instructive information on the Internet regarding business process patents. That might help you determine whether your ideas rises to the level of a patentable invention. If so, you should call a patent attorney.
