Legal Question in Business Law in New Jersey

Partner won't coorperate in dissolving....

Hi, i'm ending a partnership with a partner who has basically lost her mind.

In any case, I filed the appropriate papers with the IRS along w/ the fee and I'm sopposed to file my last return for the businesses. Well, she won't give me the bank statements for the year. I can't get them myself from the bank, because she never put my name on the business account. What can I do? How much trouble can I be in if she doesn't give me the papers to file the return? I've been filing previously for the business and for myself, and I know she's been lying on her personal returns with regard to her part of the business. I have no idea what she's been doing with the account and that is one of the reasons I'm getting out. I know she's sneaky and conniving - She's all of a suddon thinking god is talking to her now. What can i do? Any advice would be GREATLY appreciated!!

Re: Partner won't coorperate in dissolving....

You really need a good accountant and a good lawyer to resolve this. The lawyer can help you by taking the legal action necessary to get the papers you need, perhaps by subpoena to the bank and/or to your partner. The accountant may be able to file based on making some assumptions from the papers that you do have. In either case, you should seek these professionals immediately. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. As stated, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention Law Guru, there will be no charge for your first consultation. Good luck! Rob Gleaner
