Legal Question in Business Law in New Jersey

Hello, I would like to record a sales call (I am selling a product on the phone). No credit card information or personal information outside of the First name is in the call. All phone numbers will be bleeped out if they do come up. I would then like to post that call on my website with me annotating that call to show my visitors how to properly guide someone from an open to the close of a sale. Can I get into any legal issues for doing this? . It's live so if the person finds the call and then gets mad I will take it of.

I will not have the persons permission to post the calls(it's called a live dial), but no personal information will be on the call.

So long as they are giving their permission to be recorded or are clearly on notice that they are being recorded, you know as we hear all the time when we call various services, I don't foresee any issues. Of course, if later someone finds the call and are annoyed with how you are using it and decides to protest the best course of action is to stand ready to just remove it.

You need to keep in mind that unless you are going to get express written permission from them, they are certainly permitted to sue you if they though they were mislead and damaged in any way. I highly doubt that will happen and it would not be a case worth bringing but people sue out of annoyance as well.

I would discuss your plans with a lawyer in private before jumping in. If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.

Our firm is now referred by the American Bar Association (see under the New York section):
