Legal Question in Business Law in New Jersey

I am starting an online clothing business and I wanted to know if I have purchased clothing from another clothing website and sell it on my website is that illegal. I just wanted to know my rights and not run into any legal problems before I actually start up my business. Also what if they are selling the items on a wholesale site.

An attorney will say as long as you're a reseller (which means you buy at wholesale to sell at retail), there should not be a problem. You have to look into getting what is often called a seller's permit by the state(s) involved, allowing you to collect sales tax and then remit to the taxing agency. Consult with an attorney in your area for specific advice.

Generallly, you can buy wholesale and sell retail. You would need to collect sales tax on in-state sales. Please be careful if you buy brand-name or labeled merchandise for authenticity. There are so many counterfeit items, you could get stuck having to refund your customers.

If you were forward-thinking, you would get a tax and business attorney to form your business right and to provide you with legal guidance.
