Legal Question in Consumer Law in New Jersey

i have a townhome that is rented in south jersey. I have had a problem the past 10 years with water backing up thru the toilet into the home bringing raw sewage into the entire bottom floor. i have lost lots of tenants because of this. the house next door is forclosed and is now owned by one west bank. turns out the tree in their yard has grown thru the pipe and the sewege has to flow over the pipe but clogs constantly and backs up into my property causing this mess.

I have written, certified, emailed the bank and their legal office of Zucker Goldberg and Ackerman and stated that this is a health issue cause the current tenant has a small child and they ignore me.

I need some help in order to handle this situation. Thank you Ken

Since you are renting, you might treat the matter as the habitability issue that it is. That is, after notifying the landlord in writing, stop paying the rent (being careful to set it asside) and see if the landlord corrects the problem. If an eviction suit is filed against you, you pay the money into court and defend on habitability grounds. � The landlord will probably need to file suit. The bank will try to minimize its costs and it is doubtful that anything is going to be done to fix the problem unless you put some pressure on. � My firm handles matters of this type.
